Terms and Conditions

By accessing, registering on, or using the SafarYaari website, or by clicking the "I Agree" button, the User confirms that the User has read, understood and accepted these Terms and Conditions and agrees to be legally bound by them.
SafarYaari is an online intermediary platform facilitating intercity journey sharing between verified Users. SafarYaari does not own vehicles, employ drivers, operate transport services or itself undertake to transport any passenger. The actual journey is undertaken between the relevant Users or through the applicable third-party transport provider.
The Platform may be used by persons who are legally competent to enter into a binding arrangement. Every User shall provide complete, accurate and truthful information and shall maintain a valid Indian mobile number for verification.
The User shall be responsible for maintaining the confidentiality of the Account, password, OTP and other login credentials and shall not share, transfer or permit any other person to use the Account.
SafarYaari may require identity verification through a government-issued identity document before permitting a User to publish or book a Ride. Such verification is solely an authentication and safety measure and shall not constitute any guarantee, certification or endorsement by SafarYaari regarding the character, conduct, reliability or safety of the User.
Users may publish or book intercity Rides through the Platform. A User publishing a Ride shall be solely responsible for providing accurate information relating to the route, date, time, pickup location, available seats, vehicle and other relevant particulars.
SafarYaari may remove, suspend, reject or restrict any Ride, Account or transaction where it reasonably considers that the same is fraudulent, inaccurate, unsafe, unlawful, misleading or contrary to these Terms and Conditions.
SafarYaari does not guarantee that any particular Ride will be available, accepted, commenced, completed or operated at any particular time, or that any User will appear at the agreed pickup or destination location.
A User booking a Ride may be required to pay a refundable Deposit through the payment mechanism made available by SafarYaari. The Deposit is a trip-related refundable amount and shall not be treated as a transport fare or general-purpose wallet balance.
SafarYaari may deduct applicable charges, penalties, commissions or processing amounts from the Deposit in accordance with the applicable cancellation, refund and fee policies displayed on the Platform.
Payments shall be processed through the payment gateway made available by SafarYaari. SafarYaari shall not be responsible for delays, failures or errors attributable solely to any bank, payment gateway, payment network or other financial intermediary.
The User acknowledges that payment and refund arrangements may be subject to the terms, conditions and operational procedures of the applicable payment gateway.
Cancellation of a Ride or Booking shall be governed by the cancellation and refund policy applicable at the time of the relevant transaction. Depending upon the time and circumstances of cancellation, the Deposit may be fully refunded, refunded after applicable deductions, partially forfeited or forfeited entirely.
Where a User fails to appear for a confirmed Ride without cancelling in accordance with the applicable cancellation policy, such User may be treated as a no-show and the applicable Deposit may be forfeited. SafarYaari may also flag, suspend or restrict the relevant Account.
Where a Lister cancels a Ride after bookings have been made, SafarYaari may refund affected Passengers, facilitate alternative arrangements and apply the applicable penalty or deduction against the Lister in accordance with the applicable policy.
Where cancellation occurs due to circumstances beyond the reasonable control of the concerned parties, including natural disasters, severe weather, governmental restrictions, road closures, civil disturbances, war, epidemic, pandemic or other circumstances of force majeure, applicable penalties may be waived and Deposits may be returned subject to verification and case-by-case consideration.
Refunds shall ordinarily be processed to the original or source UPI account through the applicable payment gateway. The time required for the actual credit of the refund may depend upon the payment gateway, bank or payment network.
Where a Ride involves a private vehicle, commercial vehicle or community bus, the person responsible for the vehicle shall remain solely responsible for maintaining all applicable licences, permits, registrations, insurance, fitness certificates and other statutory requirements.
SafarYaari does not own, operate, maintain, inspect or control any vehicle used for a Ride and does not employ the driver of any vehicle. SafarYaari shall not be responsible for the mechanical condition of a vehicle or the conduct of its driver.
SafarYaari provides identity verification, Trust Scores, ratings, live-trip sharing and SOS-related features for facilitating safer interactions between Users. No such feature shall be construed as a guarantee of personal safety, vehicle safety, driver conduct or successful completion of a Ride.
Every User shall exercise reasonable care and independent judgment before agreeing to travel with another User and shall comply with all applicable safety requirements and laws.
SafarYaari may generate a Trust Score based upon verification, trip history and ratings. The Trust Score is an automated Platform indicator and shall not constitute a certification, guarantee or representation regarding the character, reliability or conduct of any User.
Users shall not create false identities, impersonate another person, operate multiple Accounts to circumvent restrictions, share Accounts, resell seats without authorisation, circumvent SafarYaari's Deposit mechanism, make unauthorised off-platform arrangements for avoiding applicable charges, harass or threaten another User, engage in unsafe driving, carry prohibited goods, manipulate ratings or Trust Scores, or use the Platform for any unlawful or fraudulent purpose.
SafarYaari may suspend, restrict, flag or terminate an Account where a User fails verification, provides false information, commits a no-show, engages in fraud or abuse, violates these Terms and Conditions, compromises the safety of another User or otherwise misuses the Platform.
A User shall remain responsible for all information, photographs, descriptions, ratings, reviews and other content uploaded or published by the User on the Platform.
By uploading or publishing any content on the Platform, the User grants SafarYaari a non-exclusive, royalty-free right to host, store, display, reproduce and communicate such content to the extent reasonably necessary for operation and administration of the Platform.
The User represents that all content submitted to SafarYaari is lawful, accurate and does not infringe any intellectual property, privacy or other rights of any third party.
A User may designate an emergency contact for the purpose of live-trip sharing and SOS functionality. The User represents that the emergency contact has authorised the User to provide such person's name and contact details for this purpose.
A live-trip link may be accessible to any person possessing the link while it remains active. The User shall exercise appropriate caution while sharing such link.
SafarYaari's SOS functionality is an assistance feature and shall not be treated as a substitute for directly contacting the police, ambulance, fire service or other emergency authority where immediate assistance is required.
Personal information provided by a User shall be processed in accordance with the SafarYaari Privacy Policy and applicable law. SafarYaari may process such information for account management, identity verification, Ride matching, bookings, Deposits, refunds, notifications, safety, fraud prevention, ratings, Trust Scores, customer support and legal compliance.
SafarYaari may use third-party service providers for hosting, infrastructure, identity verification, authentication, communication, payment processing, security and other operational purposes. Such providers may receive information only to the extent necessary for the services being provided.
SafarYaari presently stores Member data primarily in India, including infrastructure located in AWS Mumbai, subject to the processing arrangements described in the Privacy Policy.
SafarYaari may send transactional communications relating to Account registration, OTPs, verification, bookings, cancellations, refunds, safety alerts, Ride notifications, Account security and other necessary services. Promotional communications shall be subject to applicable consent and communication preferences.
All intellectual property rights in the SafarYaari website, software, design, logo, branding, content, databases, technology and Platform functionality shall remain vested in SafarYaari or its licensors. The User shall not copy, reproduce, modify, distribute, reverse engineer, scrape, commercially exploit or otherwise misuse any part of the Platform without the prior written permission of SafarYaari. Any violation of this provision shall entitle SafarYaari to take such necessary action as may be available to it under these Terms and applicable law, including suspension or termination of the User's Account and initiation of appropriate legal proceedings, wherever warranted.
The User shall not use any content, material, information, software or functionality available through the Platform for any commercial or unauthorised purpose without the prior written permission of SafarYaari.
SafarYaari does not guarantee uninterrupted, continuous or error-free availability of the Platform and may temporarily suspend or modify any service due to maintenance, technical problems, cybersecurity incidents, payment gateway failures, third-party service interruptions or circumstances beyond its reasonable control.
To the maximum extent permitted by applicable law, SafarYaari shall not be liable for any act, omission, misconduct, negligence, delay, cancellation, accident, injury, death, theft, loss of baggage, loss of personal property, vehicle breakdown, driver conduct, route deviation, failure of transportation or dispute between Users arising from the actual journey or conduct of another User or third party.
To the maximum extent permitted by applicable law, SafarYaari's aggregate liability arising directly from a particular Booking shall be limited to the Deposit actually held by SafarYaari in relation to that Booking. Nothing contained in these Terms shall exclude or restrict any liability which cannot lawfully be excluded or restricted.
The User agrees to indemnify and hold harmless SafarYaari, its proprietor, employees, representatives, contractors and service providers against claims, losses, liabilities, costs and expenses arising from the User's breach of these Terms, fraudulent or unlawful conduct, inaccurate information, misuse of the Platform, infringement of third-party rights or violation of applicable law.
Any complaint, grievance, dispute, technical issue or other concern relating to the Platform, Ride, Booking, payment, refund or any service provided through SafarYaari shall first be brought to the attention of SafarYaari through the designated support or grievance channel. The User shall provide SafarYaari with all relevant information, documents and reasonable assistance required for examination of the matter and shall provide SafarYaari a reasonable opportunity and reasonable period of time to investigate and resolve the issue before initiating any further proceedings or taking further action, except where immediate recourse is available or required under applicable law.
SafarYaari shall endeavour to examine and resolve grievances within a reasonable period having regard to the nature, complexity and circumstances of the matter. The User shall cooperate with SafarYaari and provide such information, documents or evidence as may reasonably be required for resolution of the grievance. If the grievance remains unresolved after the reasonable opportunity provided to SafarYaari, the User may pursue such further remedy as may be available under applicable law.
SafarYaari may amend these Terms and Conditions from time to time to reflect changes in the Platform, applicable law, services, security requirements or business operations. Any revised Terms and Conditions shall be published on the SafarYaari website and shall become effective from the date specified therein. The User is advised to review the Terms and Conditions periodically. Continued access to or use of the Platform after the revised Terms and Conditions have been published shall constitute acceptance of the revised Terms and Conditions, to the extent permitted by applicable law.
Where fresh acceptance of amended Terms and Conditions is required by applicable law, SafarYaari shall obtain such acceptance. Where fresh acceptance is not legally required, continued use of the Platform after the revised Terms and Conditions have been published shall constitute acceptance of the revised Terms and Conditions to the extent permitted by applicable law.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Subject to any statutory remedy or jurisdiction available to a User under applicable law, the courts having competent jurisdiction at Gurugram, Haryana shall have jurisdiction over disputes arising from these Terms.
If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, the remaining provisions shall continue to remain valid and enforceable to the maximum extent permitted by law.
Failure by SafarYaari to enforce any provision of these Terms and Conditions on any occasion shall not constitute a waiver of its right to enforce the same provision subsequently.
The User shall not assign, transfer or otherwise deal with any rights or obligations arising under these Terms and Conditions without the prior written consent of SafarYaari. SafarYaari may assign or transfer its rights and obligations in connection with any restructuring, business transfer, merger, acquisition or other lawful business arrangement, subject to applicable law.
These Terms and Conditions, together with the Privacy Policy, Cookie Policy, Cancellation and Refund Policy, applicable Fee Schedule and other policies expressly incorporated by reference, constitute the entire agreement between SafarYaari and the User concerning the User's access to and use of the Platform.
By clicking the acceptance checkbox and thereafter clicking the "I Agree" or equivalent button, the User confirms that the User has read, understood and voluntarily accepted these Terms and Conditions and agrees to be legally bound by them.
